Legal Basis of the Certificate: Patent & Designs Act, 1911

Description

Any person claiming to be the true and first inventor may file an application in the prescribed form, in the Department of Patents, Designs, and Trade Marks for a Patent to protect his invention in Bangladesh.

Issuance of Registration Certificate of Patent

2	Duly filed in prescribed form	Form-1 or 1A / 2 or 2A as the case may be
3	Bank draft or duly filled in Challan Form	BDT 2,000/ only in case of ordinary application having specification of 25 pages and 10 claims. More than 25 pages and 10 claims each page and each claim will be charged at Tk. 100 only
4	One set of drawing sheets in tracing paper with duplicate in photocopy.	if any

Process Steps

Step 1	Prepare Form 1 and 1A for local goods and form 2 and 2A for foreign goods
Step 2	Submit with required documents
Step 3	Examination by the examiner (The Controller shall refer to an examiner every application in respect of which a complete specification has been filed and if satisfied on the report of the examiner)
Step 4	Examiner checks whether applicant complies all substantive requirements
If complies all requirements
Step 5	Patent Office conducts Publication Inviting Opposition process, if needed
Step 6	Issuance of Letter of Patent
If not complies all requirements
Step 5	Patent office asked the applicant to complete required process
Step 6	If not completed all requirement then Patent Office rejects the application
Step 7	Applicant may appeal to the government

Renewal Process:

Must be renewed before expiration (i.e. 5 years). Renewal fees are paid in the same manner as registration fees.
